SMS Terms & Conditions

These SMS Terms & Conditions (“SMS Terms”) govern participation in SMS and MMS text messaging programs provided by Leavitt & Starck Excavating, Inc. (“Leavitt & Starck,” “we,” “us,” or “our”).

By opting in to receive text messages from Leavitt & Starck, you agree to these SMS Terms.

Program Description

Leavitt & Starck Excavating, Inc. provides SMS and MMS text messaging primarily to employees and other authorized personnel who have opted in to receive company communications.

Messages are delivered to the mobile telephone number provided by the recipient and may include:

  • Weekly Toolbox Talk reminders and related safety or training information;
  • Vehicle Inspection reminders, generally sent Monday through Friday;
  • Human Resources communications, including annual training notices, benefits information, open enrollment information, and other employment-related notices;
  • Other company operational or administrative communications; and
  • Urgent work-related, operational, safety, weather, or emergency notifications when necessary.

Messages may be transmitted through Leavitt & Starck’s text messaging service provider, Textedly, and associated telecommunications providers.

Consent to Receive Messages

By providing your mobile telephone number and opting in to the Leavitt & Starck SMS program, you authorize Leavitt & Starck Excavating, Inc. and its messaging service providers to send SMS or MMS messages to that number.

You represent that you are the subscriber, customary user, or otherwise authorized user of the mobile number provided.

Participation in the SMS program is subject to these SMS Terms and our SMS Privacy Policy.

Message Frequency

Message frequency varies.

Recurring communications may include:

  • Weekly Toolbox Talk reminders;
  • Vehicle Inspection reminders generally sent Monday through Friday;
  • Periodic Human Resources communications throughout the year; and
  • Work-related, safety, operational, weather, or emergency notifications as circumstances require.

The number of messages you receive may therefore vary based on your position, work activities, applicable company programs, and operational needs.

Message and Data Rates

Message and data rates may apply.

Any charges for sending or receiving SMS or MMS messages are determined by your wireless carrier and your wireless service plan.

Leavitt & Starck does not separately charge recipients for participating in its SMS program.

Contact your wireless carrier if you have questions regarding your messaging or data plan.

How to Opt Out — STOP

You may cancel participation in the SMS program at any time by replying STOP to a text message from Leavitt & Starck.

After you send STOP, you may receive a confirmation message indicating that you have been unsubscribed.

After your opt-out request has been processed, you will no longer receive messages through the applicable SMS program unless you subsequently opt in again.

Opting out of SMS messaging does not prevent Leavitt & Starck from communicating with you through other appropriate methods when necessary for employment, company operations, safety, legal compliance, or other legitimate purposes.

Carrier Liability

Text message delivery is subject to wireless carrier networks, telecommunications providers, messaging service providers, network availability, and device availability. Delivery of any particular message cannot be guaranteed.

Carriers are not liable for delayed or undelivered messages. Leavitt & Starck Excavating, Inc. is also not responsible for delays, failed delivery, or other transmission issues resulting from wireless networks, telecommunications providers, mobile devices, network interruptions, service outages, or circumstances outside our reasonable control.

Supported Carriers and Devices

SMS and MMS messaging may not be available through every wireless carrier or on every mobile device.

Message availability and functionality may depend upon:

  • Your wireless carrier;
  • Your wireless service plan;
  • Your mobile device;
  • Your geographic location;
  • Network availability; and
  • Other telecommunications conditions.

Leavitt & Starck does not sell or rent SMS opt-in information or mobile telephone numbers.

SMS consent, mobile telephone numbers, and SMS opt-in information will not be shared with third parties or affiliates for their own marketing or promotional purposes.

Information may be provided to telecommunications providers, messaging aggregators, carriers, and service providers when necessary to operate and deliver the SMS service.

Changes to the SMS Program

Leavitt & Starck may modify, suspend, or discontinue all or part of its SMS program when reasonably necessary.

We may also modify these SMS Terms from time to time.

Changes to these SMS Terms will be posted on this page with an updated “Last Updated” date.
